1. About the Profile

1.1 You can create a Salling Group Profile (hereinafter referred to as the “profile” or “Profile”) on certain of our websites and in certain apps.

1.2 When you create a Profile, you are entering into an agreement with Salling Group A/S, CVR no. 35 95 47 16, Rosbjergvej 33, 8220 Brabrand (hereinafter “Salling Group”, “we”, or “our”). The Profile is owned and administered by Salling Group.

1.3 It is your responsibility to read and familiarise yourself with these terms and the Privacy Policy for the Salling Group Profile, including any changes. You give your acceptance and confirmation of the terms and the privacy policy when creating the Profile.

1.4 The Profile primarily functions as a shared login for several of our webshops, subscriptions, clubs, customer programmes, etc. (hereinafter “Services”). To use certain Services, it is required that you create a Profile.

1.5 With the Profile as your login, you can access a number of benefits via the various Services, such as exclusive discounts, services, offers, competitions, etc. (“Benefits”). Certain Benefits can only be accessed in physical stores, others via our webshops, and access to some Benefits may require payment. The terms attached to the Service, or the Benefit will always specify where and how the Benefit can be accessed.

1.6 The Profile is personal and may not be used by other persons, either inside or outside your household.

1.7 Certain Services linked to your Profile may allow you, via the Profile, to share features and data with others in your household who also have a Profile (household sharing) or other forms of sharing between Profiles. For further information on sharing, please refer to the terms of the relevant Service offering sharing.

1.8 The Profile contains a number of master data (hereinafter “Master Data”) in the form of your login information (email address and password), contact information, and your unique member ID, which is linked to the payment cards you use for the individual Services. Your Master Data will also include our documentation that we are permitted to process your personal data (GDPR) and any consents you have given for receiving direct marketing.

1.9 Master Data can be used for all Services you log into with your Profile. If you create a new Service, you can use already existing Master Data from the Profile for the new Service. Please note that if you enter new Master Data in the Service, in whole or in part, this will constitute your new Master Data in the Profile.

1.10 Salling Group assumes no liability for losses that may arise because of technical errors or loss of data.

2. Creation

2.1 To create a Profile, you must have a valid email address and accept these Profile Conditions.

2.2 A Profile can be created by private individuals who are at least 18 years old and otherwise legally competent.

2.3 You are not obliged to make any purchases when creating the Profile. As part of the Profile, we collect various data about your use of the associated Services. You can read more about this in the privacy policy for the Profile and the privacy policies for the individual Services.

2.4 The creation of the Profile will always occur in connection with the use of a Service. If you unsubscribe from one of our customer clubs or terminate a subscription, you will still have your Profile.

2.5 You are responsible for ensuring that your information is correct and up to date.

2.6 When creating the Profile, you must enter a personal password linked to your chosen email address. If you have forgotten your password, you can receive a new one by clicking the “Forgot password” or a similar link at login and following the instructions, or by contacting Salling Group customer service.

2.7 You may instead choose to use your login from social media or other digital services to create and log into the Profile. This can only be done on websites and apps that support this function. Read more in the privacy policy for the Profile, which you can find here.

3. Changes

3.1 Salling Group reserves the right to change these terms and conditions.

3.2 In the event of significant changes, you will receive a notification via email or other chosen communication method at least 14 days before the changes take effect.

3.3 If you cannot accept the changes, you always have the option to delete your Profile. Please note that you cannot delete your Profile until you have unsubscribed from all your associated Services, as the Service depends on the Profile.

4. Deactivation and Deletion of the Profile

4.1 You may at any time deactivate your Profile by logging into the Profile and following the deactivation instructions on the Services where the Profile can be used.

4.2 If you deactivate your Profile, you will no longer be able to log in.

4.3 Deactivating the Profile means that you lose the ability to use our Services and associated Benefits. You will also lose any earned points, coupons, gifts, etc.

4.4 Your Profile will be automatically deleted 2 months after you have deactivated it.

4.5 Unless there is a breach of terms, you may, within 2 months of deactivation, request Salling Group to reactivate the Profile, whereby you will, as far as possible, continue with the same information and benefits that were attached to the Profile at the time of deactivation.

4.6 In addition to deactivating your Profile, you may request to have it deleted in accordance with data protection legislation (GDPR).

5. Security and Protection Against Misuse

5.1 You should not share your profile information, including your username and password, with others.

5.2 Salling Group is not responsible for misuse of your Profile or our Services because of you sharing your profile information with others.

5.3 You are responsible for ensuring that the information provided to Salling Group is correct and up to date.

5.4 We never send messages asking you to provide payment card information. If you receive messages asking you to provide payment card information and which appear to come from Salling Group, you should not respond to these.

5.5 We may deactivate your Profile to protect you, Salling Group, or our partners against misuse or loss of your personal data and other data.

6. Personal Data

6.1 We refer to our privacy policy for the Profile, which you can find here.

7. Service Notifications

7.1 We may contact you with service notifications such as:

(i) information about your Profile

(ii) guidance on how to get the most out of your Profile, and

(iii) information about new features, updates, changes, content, etc. regarding the Profile.

We may contact you by email, telephone (including calls and SMS), or by regular mail.

The information will also be available where you can log in with the Profile.

8. Customer Support and Complaints

8.1 You can find all versions of these Profile Conditions and the privacy policy for the Profile at sallinggroup.com.

8.2 You can contact customer service at: profil@sallinggroup.com.

8.3 We always strive to respond to your inquiry as quickly as possible.

8.4 The normal opening hours for customer service are every day from 8:00 to 20:00. If you contact customer service outside opening hours, a case will be created, and customer service will get back to you as soon as possible at the email address you have provided.

9. False Profiles and Breach of Terms

9.1 We reserve the right to delete Profiles that we consider unserious or otherwise do not contain truthful information, or in the event of a breach of these terms.

9.2 Breach may, for example, consist of failure to comply with your obligations under these Profile Conditions as well as misuse of the Profile, Benefits, personal data, or other data.

10. Applicable Law

10.1 These terms and conditions are governed by and are to be interpreted in accordance with Danish law.

10.2 The terms and conditions do not limit any mandatory consumer rights.

11. Validity and Liability

11.1 If any provision of these terms is found to be invalid, illegal, or unenforceable, the remaining provisions will retain their full validity.

11.2 Salling Group is not responsible for breakdowns of IT systems in stores and on the Services, which result in any Benefit, including a discount, not being available. Any lost Benefits cannot be obtained retroactively. Contact Customer Service via the relevant page or app where you created or access your Profile if you have questions regarding your potential Benefits.

12. Terms for Business Profiles

If you are an employee in a private company or organisation that has a Salling Group business account, your Salling Group Profile may be linked to it.

You can read below and at Creation of a new Salling Group Business Card – Business Card, how to link a company or organisation’s business account to your profile.

You will then be able to use your profile and the linked business account on behalf of the company/organisation (“account holder”). We call this a Business Profile.

To the extent that your profile is used on behalf of a company/organisation, the terms in this section apply, and such use will not be subject to Danish consumer law.

Sections 1-11 also apply to Business Profiles.

12.1. General about Business Profiles

With a Business Profile, you can transact on behalf of the company/organisation on those of our online formats that accept Salling Group Business Card as a means of payment.

On the Salling Group Business website, you can find an overview of all online formats where you can shop with a Salling Group Business Card.

This overview is continuously updated as it becomes possible to use the Business Card in new stores and/or online platforms.

The Salling Group Business website can be found at Business Card (sallinggroup.com). If your company/organisation has not already created a business card, this can be done via the site.

The use of the Business Card is subject to the separate terms accepted by the company/organisation upon creation, with any subsequent changes.

12.2. Linking a Profile to a Salling Group Business Card

You can choose to request a new Salling Group Business Profile or have your existing Salling Group Profile linked to the company/organisation’s business account.

This means you can choose to use the same email and password to log in, and then choose whether you want to transact privately or on behalf of the business account linked to your profile – or you can choose to have a new Salling Group Business Profile created with a different email.

In both cases, you will be asked to declare that you are authorised to transact on behalf of the company/organisation.

You are responsible for informing the account holder of all matters regarding your profile that may be relevant to the account holder.

12.3. Personal Data

Personal data processed in connection with the creation and use of a Salling Group Business Profile and Business Card is processed as stated in the privacy policy for the Salling Group Profile and Business Card. The privacy policy can be found at Salling Group Profile Privacy Policy.

In connection with linking your profile to the company/organisation, you will be asked to confirm that you have been informed about the processing of your personal data.

12.4. Misuse

If Salling Group becomes aware that you misuse your Salling Group Business Profile or do not comply with these terms, Salling Group reserves the right to remove the link to the company/organisation and/or to close your profile and exclude you from future use of a Salling Group Business Profile.

It is your and the company/organisation’s responsibility to inform Salling Group if you become aware of or suspect misuse of your profile.

12.5. Inactivity and Request for Removal of Link

In the event of inactivity on the business account for more than 12 months, Salling Group reserves the right to remove the link to the company/organisation.

Salling Group may, at the request of the company/organisation and without further notice, remove the link between your profile and the company/organisation.

In both cases, your profile will lose its status as a Business Profile.

12.6. Disclaimer

Salling Group cannot be held liable for any damages, liabilities, or losses you or the company/organisation may incur because of the linking and use of your Salling Group Profile on behalf of the company/organisation, including removal of the link pursuant to section 12.5.

Any disputes you may have with the company/organisation regarding the linking and use of the Business Profile are of no concern to Salling Group.

12.7. Jurisdiction

Any dispute between the parties shall be settled by the Court in Aarhus.
